What is Employment Practices Liability (EPL) insurance?

EPL insurance is a relatively new form of liability insurance. It provides protection for an employer against past, present and future employees. It covers your firm including its directors and officers.

Areas of cover include:

  • Age discrimination
  • Sex discrimination
  • Racial discrimination
  • Wrongful dismissal
  • Sexual harassment
  • And other employment related issues

Why do I need employment practices liability insurance?

Cases against employers are on the rise and it can happen to any firm. New firms or firms with new managers/management teams can be especially vulnerable where enough time hasn't elapsed to fully embed procedures. However, even established firms can be vulnerable right from selecting who to interview through to exit interviews.

Every employer faces the risk of legal action and it could come from a joke made in the tea room or from a prospective employee whose CV did not get them through to the interview stage.

Examples of EPL claims that can be made:

  • An employee was dismissed due to not taking information in quick enough. It was found this was due to dyslexia which was declared at the interview stage. The employee was successful in their claim because the employer had not taken the disability into account.
  • A female employee was made redundant from a team where she was the only female. She claimed unfair selection on the grounds of sexual discrimination.
  • Claimant dismissed on the grounds of capability. Claimant was successful due to procedures not being followed.
